D.C. Council Votes Unanimously to Prohibit Pre-Employment Drug Testing for Cannabis Use

Washington D.C.’sRecreational cannabis use could be legal after the votes Council has given approval to legislation which would prohibit employers from testing potential employees for cannabis use. The vote was unanimous.

The proposal, titled the Prohibition of Pre-Employment Marijuana Testing Emergency Act, was introduced by Councilmember Vincent Orange and would ban employers from testing for cannabis until after an offer for employment has been made.

After such an offer has been made, and the individual has been hired, the employee must still “adhere to the workplace policies set forth by their employer”, meaning they can still be tested for on-the-job cannabis use.

“The citizens of the District voted for Initiative 71, to legalize marijuana, and this bill will protect citizens who legally smoke marijuana but are then subsequently penalized for it through loss of employment opportunities,” says Councilmember Orange. “The bill aims to prevent the loss of a job opportunity for job seekers who have used marijuana prior to receiving a job offer but it does not remove an employer’s right to prohibit the use of drugs at work or at any time during employment.”

The proposal will need to be approved by the Council again before heading to the mayor for consideration.

    Drug testing does not prove intoxication or measure job performance. Just because you work for a company that should not give them ownership of employees, what people do on their own time should be their own business. The Government lets companies get away with violating our 4th amendment rights. They are other ways of detecting intoxication other than taking blood or urine, like field sobriety test just like the police do beside the road when suspected of being intoxicated. If it’s good enough for the police it should be good for the employer !!!
