Oregon Bans Child Care Providers from Being Medical Cannabis Patients

plOregon’s Early Learning Council, which oversees child care providers in the state, has voted to deny child care licenses to anyone who holds a medical cannabis card, and anyone who grows, uses or distributes cannabis for any reason.

The Council’s vote follows a six-month moratorium on licenses to medical cannabis patients, which was approved in August. Specifically, the new rules:

  • Prohibit child care providers from holding medical marijuana cards
  • Prohibit child care providers from using any form of marijuana in a child care home during child care hours or when child care children are present
  • Prohibit anyone under the influence of marijuana from having contact with child care children
  • Prohibit anyone from growing or distributing marijuana on child care premises
  • Permit children with medical marijuana cards to be medicated on child care premises

Those who are opposed to this discriminatory move (other legal medications aren’t prohibited) should contact the Early Learning Council and give them their opinion; contact information can be found by clicking here.

I suppose that they think that they’re “being responsible,” but wouldn’t it be more responsible to instead enact similar legislation but with the word “marijuana” replaced with “alcohol” or perhaps the word “Intoxicants”? Abuse of alcohol is known to lead to many terrible things and I have yet to see any evidence that marijuana poses nearly as much of a threat.
I can understand concerned parents wanting to prevent their kids from accidentally eating someone’s pot brownies and that society needs to protect children. I advocate and even greater penalty for such negligence, perhaps as much as an additional six months in jail for “abject stupidity.” I mention this because this licensure policy presupposes stupidity on the part of parents and caregivers…of course, if people didn’t do stupid things we wouldn’t need a lot of laws and regulations telling them what not to do.
